Terms of Use

Last updated

These terms apply to your use of fintrix.so (the "website"). By using the website, you agree to them. If you do not agree, please do not use the website.

In these terms, "Fintrix", "we", "us" and "our" mean the company named in the footer of every page. "You" means anyone who uses the website.

These terms and our services

These are terms of use for the website only. They do not cover any services we provide.

All client engagements, including discovery sprints, dedicated teams and fixed-scope projects, are governed by a separate written agreement signed by Fintrix and the client. Nothing on the website, including descriptions of our services, engagement models, timelines or outcomes, forms part of a contract or is an offer capable of acceptance. If a signed agreement conflicts with these terms, the signed agreement wins.

Our Privacy Policy and Cookie Policy explain how we handle personal data and browser storage. They are separate from these terms.

Using the website

You may use the website for lawful purposes: to learn about Fintrix, read our content, contact us, subscribe to our newsletter and apply for jobs.

The website is free to use and does not require an account. We may change, suspend or withdraw any part of it at any time without notice. We do not promise that the website, or any content on it, will always be available or uninterrupted.

Intellectual property

The website and everything on it, including text, articles, case studies, graphics, illustrations, diagrams, code samples, the Fintrix name and logo, and the design and arrangement of the site, are owned by Fintrix or our licensors and are protected by copyright, trade mark and other intellectual property laws.

You may:

  • view, download and print pages for your own personal or internal business reference;
  • share links to any page;
  • quote short extracts from our articles with a clear credit to Fintrix and a link to the original page.

You may not, without our written permission:

  • copy, republish, sell or otherwise commercially exploit the website or its content, other than as allowed above;
  • use the Fintrix name, logo or other branding in a way that suggests we endorse you, your product or your service;
  • remove or change any copyright, trade mark or other notice.

Code samples. Unless a code sample states otherwise, you may use, copy and adapt short code snippets from our articles in your own projects. They are provided "as is", without any warranty.

Acceptable use

When using the website, you must not:

  • break any applicable law or regulation, or help anyone else do so;
  • try to gain unauthorised access to the website, the servers it runs on or any connected system, or interfere with its security (good-faith security research under our Security policy is welcome);
  • introduce viruses, malware or other harmful material;
  • overload, flood or attack the website, including through denial-of-service attacks;
  • use automated tools to scrape or collect content or data from the website in bulk, except for search engine indexing that respects our robots.txt file;
  • use our contact form or email addresses to send spam, unsolicited marketing or abusive, misleading or unlawful content;
  • impersonate anyone or misrepresent your connection with any person or organisation.

We may block access to the website, or ignore messages, from anyone who breaks these rules.

Information you send us

When you send us an enquiry, job application or other message, you confirm that the information is accurate and that you are entitled to share it. Please do not send us confidential information through the contact form or by email before we have a confidentiality agreement in place. Until then, we cannot treat what you send as confidential, although we will always handle personal data in line with our Privacy Policy.

If you send us ideas, suggestions or feedback about the website or our services, we may use them without any obligation to you.

The website contains links to websites and services run by other people, such as social networks and the providers that process our forms. We include these links for convenience only. We do not control those sites, are not responsible for their content, availability or privacy practices, and do not endorse them by linking to them. Your use of a third-party site is governed by that site's own terms.

You may link to our home page or any other page, as long as you do it fairly and lawfully and do not suggest any association, approval or endorsement by us that does not exist. You must not frame the website on another site.

No professional advice

Our articles, case studies, guides and other content are general information. They are not professional, technical, legal, financial, regulatory or security advice for your circumstances, and you should not rely on them as such. Case studies are anonymised, and results described in them depend on the specific project and may not be repeated in yours.

Before you act on anything you read on the website, you should get advice that takes your own situation into account. If you would like advice from Fintrix, that will be provided under a separate signed agreement.

Disclaimers

We work to keep the website accurate and up to date, but we provide it, and all of its content, "as is" and "as available". To the fullest extent permitted by law, we make no promises or warranties, express or implied, that:

  • the content is complete, accurate or current;
  • the website will be secure, error-free or free from viruses;
  • the website will meet your requirements.

You are responsible for using your own virus protection and for configuring your devices to access the website.

Limitation of liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law. If you are a consumer, nothing in these terms affects your statutory rights.

Subject to that, and to the fullest extent permitted by law:

  • we are not liable for any loss of profit, revenue, business, contracts, goodwill or anticipated savings, for any loss or corruption of data, or for any indirect or consequential loss, arising from your use of, or inability to use, the website or its content, whether in contract, tort (including negligence), breach of statutory duty or otherwise;
  • because the website is provided free of charge, our total liability to you for all claims arising out of or relating to the website or these terms is limited to one hundred US dollars (US$100).

This section does not apply to any client engagement. Our liability to clients is set out in the relevant signed agreement.

Indemnity

If you are using the website on behalf of a business, you agree to indemnify Fintrix against any claims, losses, damages and reasonable costs (including legal fees) that arise from your breach of these terms or your misuse of the website.

Governing law and disputes

These terms, and any dispute or claim arising out of or in connection with them or the website (including non-contractual disputes or claims), are governed by the laws of the country in which Fintrix is incorporated. The courts of that country have exclusive jurisdiction, except that we may bring proceedings to protect our intellectual property in any court with jurisdiction.

If you are a consumer, you also keep the protection of any mandatory laws of the country where you live, and you may bring proceedings in the courts of that country.

  • Changes to these terms. We may update these terms from time to time. The "Last updated" date at the top of the page shows when we last changed them. The version on this page when you use the website is the one that applies, so please check it now and then.
  • Severability. If a court finds any part of these terms invalid or unenforceable, the rest stays in effect.
  • No waiver. If we do not enforce a right straight away, we can still enforce it later.
  • Assignment. We may transfer our rights and obligations under these terms to another organisation. You may not transfer yours without our written consent.

  • Entire agreement. These terms, together with the policies they refer to, are the whole agreement between you and us about your use of the website.
